The Personal Data (Privacy) Ordinance (the "Ordinance") came into operation on 20 December 1996. The Ordinance regulates the collection, storage and use of date relating to individuals and applies to all data users. Data is any representation of information including an expression of opinion in any document and includes a personal identifier.

The Ordinance was introduced because the Hong Kong Government felt it was necessary to protect individuals from the abuse of personal data collected on them and to bring Hong Kong into line with developed countries which already had data protection legislation. Go Yeah Limited ("GoYeah") has obligations under the Ordinance.

This statement describes GoYeah's personal data protection policy and sets out how GoYeah deals with your personal data.

The Ordinance is based on six fundamental principles. GoYeah will strictly follow these principles. The principles are summarized below.

Principle 1 - Collection

GoYeah collects process and utilizes your personal data when you visit the Website and apply for registration of a member of the Website. GoYeah collects your personal data (such as real full name, e-mail address, sex, educational background, marital status, birthday, age, blood type, residential city), only to carry out the Services offered by us. These data are forwarded to GoYeah's responsible department or person. All your personal data are provided to GoYeah on a voluntary basis but if you do not provide GoYeah with all mandatory personal data GoYeah requested, GoYeah may not be able to provide the Services to you under the Website.

General information related to the use of the Website (such as number of visitors, visited pages or duration of usage) is saved and analyzed if necessary, in order to carry out the acceptance test for individual web page. The collection of this data shall, unless otherwise indicated, undertaken in an anonymous form for statistical purposes and serve the market research.

PIn addition, GoYeah assures you that GoYeah would comply with the stated principles for the use of data, so that you would feel safe when using the Website.

GoYeah will treat your personal data as confidential. However, from time to time, GoYeah may need to disclose your personal data to other persons in order to carry out our activities or because GoYeah is required to do so by law. Where possible, GoYeah will try to ensure that the recipient of the personal data also agrees to treat it as confidential and in accordance with the provisions of the Ordinance.

Types of personal data that may be collected or held by us include:

(1)name;

(2)contact details including telephone number, fax number, address, email address, pager number, etc.;

(3)identity card number;

(4)occupation;

(5)age;

(6)nationality;

(7)marital status;

(8)education level;

(9)monthly income;

(10)results, records and accumulative progress from visiting interactive content;

(11)inquiries, suggestions or opinions;

(12)interests and preferences;

(13)computer operating system and details of internet service providers;

(14)credit card number if you place an order with us.

We collect personal data about you from various types of sources and hold such personal data for the following purposes:

(1)sending information in relation to our products and services, activities, competitions, promotions and events;

(2)marketing and promotional purposes for us, our vendors and business partners and other selected companies;

(3)joint marketing schemes with other parties;

(4)customizing the advertising and content you visit so as to streamline your experience at the Website (www.goyeah.com) and to provide personalized marketing and promotional information;

(5)fulfilling your orders for products and services, order processing and payment clearing for online shopping;

(6)responding to your inquiries;

(7)membership registration and offering benefits and privileges;

(8)collecting statistical information, conducting analysis and providing anonymous reporting for internal and external clients;

(9)conducting surveys relating to our customers, products or services;

(10)evaluation and further enhancement of our products and services;

(11)fulfilling any purpose directly related to the above purposes.

Principle 2 - Accuracy and retention

GoYeah will, where practicable, take steps to ensure that the personal data.

GoYeah maintains on you are accurate, but you should note that responsibility for informing us of changes in your personal data rests with you. GoYeah cannot establish whether your personal data are correct unless you notify us of any changes. If your personal data are incorrect, GoYeah will take steps to correct such personal data before GoYeah uses such data or will ensure that they are erased.

GoYeah will from time to time review whether GoYeah still need to keep your personal data. If you cancel your account GoYeah will still retain your data for a period of seven (7) years in case there are any claims relating to your use. Personal data which are no longer required will be deleted.

Principle 3 - Use

Unless with your consent, GoYeah will not use your personal data for any purpose other than the purpose for which they were collected (or a directly related purpose)

Principle 4 - Security

GoYeah will take reasonable and practical steps to protect your personal data against unauthorized or accidental access, processing, erasure or use. GoYeah has produced a Code of Practice to provide guidance to staff.

Principle 5 - Information

By this Agreement, GoYeah has informed you on or before collecting personal data from you:

(1)why GoYeah is collecting your personal data;

(2)the purposes for which this may be used;

(3)whom it may be transferred to; and

(4)our policies and practices in relation to personal data.

Principle 6 - Access and correction

In accordance with the Ordinance, you are entitled to write to us:

(1)1. to ascertain whether GoYeah holds personal data on you; and, if so

(2)2. to ask for a copy of such personal data; and

(3)3. to require any inaccuracies in such personal data to be corrected.

You may make such request with the forms available in the Website for such purpose. GoYeah may charge you a fee to cover our administrative costs.

The following categories of information are exempt from Principle 6 (access to personal data) and need not be supplied to the data subject:

(1)Personal data relevant to staff planning proposals to fill any series of positions of employment or cease any group of individuals' employment. This exemption only applies to proposals which relate to more than one employee. A proposal involving only one employee may fall under the exemption relating to the evaluation of personnel.

(2)Personal references given by an individual other than in the ordinary course of his occupation and relevant to another individual's suitability or otherwise to fill a position of employment or office.

(3)Personal data held by or on behalf of the Government for the purposes of security, defense or international relations.

(4)Personal data held for the purposes of prevention or detection of crime; the apprehension, prosecution or detection offenders, or the assessment or collection of any tax or duty. Some of this data may also be exempt from Principle 3.

(5)Personal data which could be subject of a claim to legal professional privilege.

You are welcome to contact GoYeah by e-mail. Any reply to you will normally be made through e-mail. GoYeah would like to draw your attention to the possible risk of such e-mails being accessible to unauthorized third parties.

The personal data that you provide will only be used by us for the purpose of responding to your enquiries and any other directly related purpose. You have the right to request access to, and correction of, personal data relating to you that are held by us. An application for access and correction may be made by contacting our Manager (rayyip@esun.com ) .

We may take reasonable steps to verify your identity before granting access or permitting corrections to your personal data. We will endeavour to respond within 60 days of your request in compliance with the Personal Data (Privacy) Ordinance. Please note that we will not retain your personal data longer than necessary.

GoYeah will not carry out matching procedures. A matching procedure is any procedure whereby personal data collected for one or more purposes in relation to 10 or more data subjects is mechanically compared with data collected for another purpose where the comparison is for the purpose of producing or verifying data which may be used for the purpose of taking action that may adversely affect any of the relevant data subject's right, benefits, privileges or obligations.

All personal data you give us is kept confidential and protected, but we may provide such personal data to the following parties for the same purposes as laid out above in this privacy policy:

(1)1. our subsidiaries, associated companies and other related companies;

(2)2. our vendors and business partners;

(3)3. parties which assist us in carrying out the purposes laid out above in this privacy policy;

(4)4. parties which participate in joint marketing scheme with us;

(5)5. any agent, contractor or service provider who provides administrative, order processing, payment clearing, credit reference, debt collecting or other services necessary to the operation of our business;

(6)6. any other person or organization who are bound by confidentiality agreements with us; and

(7)7. any person to whom we are, in our belief in good faith, under an obligation to make disclosure as required by any applicable law.

GoYeah may also provide aggregate statistics about our Users, sales, traffic patterns and related site information to reputable third-party vendors, but these statistics will include no personal data that uniquely identifies an individual.

By using our website, you consent to the collection and use of your personal data in a manner consistent with these privacy policy. If GoYeah decides to change this privacy policy, we will post those changes on this page, so you will always be aware of our policies and practices in relation to personal data.

When you click on links and/or ad banners that take you to either third-party web sites, you will be subject to the privacy policies of those parties. Whilst we support the protections of privacy on the Internet, GoYeah cannot be responsible for the actions of parties outside our web domain.
